Abstrakt
In mid-April 2015, it was passed in Poland Ordinance of the Minister of Health of 2 April 2015 amending the regulation on the issue of medicinal products and medical devices from pharmacie. The presented document - the first in the Polish legal system - introduced the possibility of independent use by a minor from the benefits of a medical nature. This applies to people who have completed 15 years of age gained free access to EllaOne. This product belongs to the category of emergency contraceptive adopted after sexual intercourse. The emergence of similar powers led to a state in which the child - without a prescription or without the consent of a parent or guardian - granted the opportunity to purchase drug that affects his fertility. In the comments it was pointed out that similar action is completely contrary to the definition of legal capacity, which is written in the Polish Civil Code. It was emphasized that such action may cause a relaxation of family relationships and the consolidation of demoralized attitudes among young people. At the beginning of 2017, the Polish government decided to introduce the obligation for the patient to have a prescription to purchase the indicated preparation. The children have been deprived of the possibility of free purchase of the ellaOne. For nearly two years, however, there was a similar opportunity. As a result, young people - contrary to the principles of Polish law - undertook legal actions to which they did not have formal competences. At this point, analyzing the importance of these rules it is worth to considering: s the provision of contraceptives to children was the realization of the idea of children's rights, or - on the contrary - it was an example of their denials.
